NAACP sues over pro-life parody

November 2014 – The Radiance Foundation  and its founder, Ryan Bomberger, are being sued for creating a parody of the NAACP logo. The parody referenced pro-abortion policies of NAACP in light of the fact that African-Americans are often victims of the abortion industry.

NAACP filed suit on the grounds of trademark infringement, confusion and dilution. Federal District Judge Raymond Jackson ruled that the First Amendment does not protect parodying an organization’s name in news articles. 

Bomberger is taking the case to the 4th U.S. Circuit Court of Appeals on the grounds of freedom of speech and freedom of the press.
