May 2020The 2nd U.S. Circuit Court of Appeals in Manhattan ruled to allow the Trump administration to withhold millions of federal dollars in law enforcement grants from states refusing to cooperate with U.S. immigration enforcement: New York, Connecticut, New Jersey, Washington, Massachusetts, Virginia, and Rhode Island.

The decision conflicted with three previous federal appeals court decisions, but the 2nd Circuit said the plain language of relevant laws clearly specify that the U.S. attorney general can impose conditions on states and municipalities which receive federal funds. Furthermore, the U.S. Supreme Court has repeatedly observed that the federal government maintains broad power over states concerning immigration policies.

Judge Reena Raggi for 2nd Circuit’s three-judge panel explained that the conditions in question would help the federal government enforce national immigration laws and policies supported by all successive administrations, regardless of political affiliation.

Members of the Justice Department praised the ruling as a major victory for Americans.
