Idaho will ban most abortions if Roe is overturned

August 2020 – Should the U.S. Supreme Court overturn the landmark 1973 Roe v. Wade decision, a newly signed law in Idaho will ban most abortion procedures in the state. Gov. Brad Little (R) signed SB 1385 into law on March 24; it will be enacted if the Supreme Court decides to make abortion a state matter.
The bill, which received strong support in the Idaho Legislature, states in part, “Every person who performs or attempts to perform an abortion as defined in this chapter commits the crime of criminal abortion,” and “Criminal abortion shall be a felony punishable by a sentence of imprisonment” from two to five years.
The bill does exempt abortions in cases of rape, incest, or medical emergencies. Additionally, the bill prohibits criminal punishment for the woman seeking the abortion.
